1. Acceptance of Terms
By accessing and using Top AI Academy's website and services, you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use our services.
These Terms and Conditions apply to all users of the site, including students, instructors, and general visitors.
2. Educational Services
2.1 Course Enrollment
- All course enrollments are subject to availability
- Minimum class sizes may apply for courses to proceed
- We reserve the right to cancel or reschedule courses with reasonable notice
- Students must be 18 years or older, or have parental consent if under 18
- Enrollments are governed by these Terms as well as the Australian Consumer Law (ACL)
2.2 Course Content
Course materials, curriculum, and schedules are subject to change. We strive to maintain the highest quality of instruction and will notify students of any significant changes to enrolled courses.
2.3 Attendance
Students are expected to attend all scheduled sessions. Excessive absences may result in removal from the course without refund. Session recordings may be provided for enrolled students who miss classes.
3. Payment Terms
3.1 Course Fees
- All fees are in Australian Dollars (AUD) and inclusive of GST unless otherwise stated
- Payment is required in full at the time of enrollment unless payment plans are arranged
- Prices are subject to change but will not affect existing enrollments
- Payment can be made via credit card, debit card, or bank transfer
- Tax invoices will be provided for all payments in accordance with Australian tax law
3.2 Payment Plans
Payment plans may be available for eligible courses. Contact us to discuss payment plan options. Failure to make scheduled payments may result in suspension of access to course materials.
4. Refund Policy
4.1 Full Refunds
Full refunds are available if:
- Cancellation is made at least 7 days before the course start date
- Top AI Academy cancels or significantly changes the course
- The course is cancelled due to insufficient enrollment
4.2 Partial Refunds
Partial refunds (50% of course fee) are available if cancellation is made 3-6 days before the course start date.
4.3 No Refunds
No refunds will be provided for:
- Cancellations made less than 3 days before course start
- Voluntary withdrawal after course commencement
- Removal due to violation of code of conduct
- Private coaching sessions not cancelled 24 hours in advance
4.4 Refund Processing
Approved refunds will be processed within 14 business days to the original payment method.
5. Code of Conduct
All students must maintain professional and respectful behavior. We maintain a zero-tolerance policy for:
- Harassment, discrimination, or bullying of any kind
- Disruptive behavior during classes
- Plagiarism or academic dishonesty
- Sharing course materials without authorization
- Any illegal activities
Violation of the code of conduct may result in immediate removal from the course without refund and potential legal action.
6. Intellectual Property
6.1 Course Materials
All course materials, including but not limited to presentations, videos, code samples, and documentation, are the intellectual property of Top AI Academy and protected by copyright law.
6.2 Permitted Use
Students may use course materials for personal learning purposes only. Distribution, reproduction, or commercial use of materials is strictly prohibited without written permission.
6.3 Student Work
Students retain ownership of projects and work created during courses. However, by enrolling, students grant Top AI Academy permission to use anonymized student work for promotional and educational purposes.
7. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms is intended to exclude, restrict, or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) or any other applicable Australian law that cannot be excluded, restricted, or modified by agreement.
8. Limitation of Liability
Subject to Section 7 (Australian Consumer Law), Top AI Academy makes no guarantees regarding:
- Employment outcomes or career advancement
- Certification or licensing eligibility
- Specific skill acquisition or learning outcomes
- Compatibility with specific software or hardware
To the maximum extent permitted by law, our liability is limited to the fees paid for the specific course or service in question. We are not liable for indirect, consequential, or incidental damages except where such liability cannot be excluded under Australian law.
9. Data Protection and Privacy
We collect and process personal information in accordance with our Privacy Policy, the Australian Privacy Act 1988 (Cth), and the Australian Privacy Principles (APPs). We comply with the Notifiable Data Breaches (NDB) scheme and will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) of eligible data breaches.
10. Termination
We reserve the right to terminate or suspend access to our services for any user who violates these terms or engages in conduct we deem inappropriate or harmful to other students or our business.
11. Dispute Resolution
If a dispute arises under these Terms, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved informally, either party may refer the matter to mediation administered by the Resolution Institute (or its successor) before commencing court proceedings.
Nothing in this clause prevents a party from seeking urgent interlocutory relief from a court of competent jurisdiction.
12. Modifications to Terms
Top AI Academy reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the modified terms.
13. Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia, and the applicable laws of the Commonwealth of Australia, including the Competition and Consumer Act 2010 (Cth). Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of Victoria.

15. Severability
